SENDT  

Terms and Conditions of Use

These terms apply to all users of SENDT, including free and paid subscribers. Please read them before using the service. By accessing SENDT, you agree to be bound by these terms.  

 

1. About SENDT  

SENDT is a digital target bank for educators supporting pupils with special educational needs and disabilities. It is operated by SENDT, a trading name of Melanie Badcock, based in the United Kingdom.  

References to "SENDT", "we", "us", or "our" throughout these terms refer to SENDT and its operator. References to "you" or "your" refer to the individual or organisation using the service.

2. Using SENDT  

SENDT is provided for professional use by educators, including teachers, SENCOs, teaching assistants, and other school staff supporting pupils with SEND.  

By using SENDT you agree to:  

  • use the service only for its intended purpose — supporting the writing of individual education plans and similar planning documents  

  • provide accurate information when creating an account or purchasing a subscription  

  • keep your login credentials and any subscriber access links secure and confidential  

  • not use the service in any way that is unlawful, harmful, or fraudulent  

 

3. Licence and Acceptable Use  

When you access SENDT, we grant you a limited, non-exclusive, non-transferable licence to use the service in accordance with these terms.  

Your licence is personal to you. You may not share your account credentials, subscriber access link, or password with anyone outside of the licence you have purchased. Specifically:  

  • An Individual licence is for one named user only  

  • A Small School licence covers up to 6 teaching staff at one named school  

  • A Standard School licence covers up to 15 teaching staff at one named school  

  • A Large School licence covers all teaching staff at one named school  

  • A MAT licence covers all teaching staff across the schools named at the point of purchase  

 

Sharing access beyond your licence tier is not permitted. If we have reasonable grounds to believe that access is being shared beyond the scope of your licence, we reserve the right to suspend or terminate your access without refund.  

You may not copy, reproduce, redistribute, scrape, or republish any part of the SENDT target bank — in whole or in part — without our prior written permission.  

 

4. Subscriptions, Payment and Cancellation  

SENDT is free to access within the limits of the free tier. Paid subscriptions unlock unlimited access in accordance with the plan purchased.  

Billing. Subscriptions are billed annually. Payment is taken at the point of purchase and on each renewal date thereafter. All payments are processed securely through Stripe.  

Invoicing. Schools and MATs may request payment by invoice and BACS transfer. Please contact hello@sendt.org.uk to arrange this before purchase.  

Renewal. You will receive an email reminder before your subscription renews. You can cancel at any time before your renewal date through your account dashboard or by contacting us directly.  

Cancellation. If you cancel, your access continues until the end of your current billing period. We do not offer partial refunds for unused time within a subscription period.  

Refunds. We will offer a full refund if you contact us within 14 days of purchase and have not made significant use of the service. After 14 days, or where the service has been used, refunds are at our discretion. This does not affect your statutory rights.  

Price changes. We reserve the right to change our pricing. We will give you at least 30 days' notice of any price increase before it affects your subscription.  

 

5. Intellectual Property  

All content within SENDT — including the target bank, category structure, interface design, copy, and documentation — is the intellectual property of SENDT and its operator.  

Nothing in these terms transfers any intellectual property rights to you.  Your licence to use SENDT does not include any right to reproduce, adapt, distribute, or create derivative works from the SENDT target bank as a whole, or any substantial part of it. Copying and adapting individual targets for use in your own planning documents is permitted and is the intended use of the service. 

SENDT’s name, logo, and brand identity are protected. You may not use them without our prior written permission.

6. Data and Privacy  

We take your privacy seriously. This section summarises how we handle personal data. Our full Privacy Policy is available at sendt.org.uk/privacy.  

Data we collect. When you create an account, we collect your name and email address. We do not collect or store any pupil data. You never enter a pupil’s personal details into SENDT.  

How we use your data. We use your name and email address to manage your account, process your subscription, and send you service-related communications such as renewal reminders. We do not sell or share your personal data with third parties, except where required to deliver the service (for example, payment processing through Stripe).  

Your rights. Under UK GDPR, you have the right to access, correct, or request deletion of your personal data at any time. To exercise these rights, contact us at hello@sendt.org.uk.  

Cookies. SENDT uses only essential cookies required for the service to function. We do not use advertising or tracking cookies.  

Data storage. Your data is stored securely within the UK and EEA. We retain account data for as long as your account is active, and for up to 12 months after account closure.  

 

7. Disclaimer — Targets and Specialist Advice  

SENDT provides a bank of ready-to-use targets intended as starting points for individual education plans and similar planning documents. All targets have been written and reviewed by experienced practitioners.  

SENDT does not replace specialist advice. Where a pupil is receiving support from a specialist — including a speech and language therapist, educational psychologist, occupational therapist, or any other professional — their professionally-set targets should always take precedence over SENDT targets in that area. 

SENDT targets should be used as part of a broader professional judgement about each pupil’s needs. We do not accept liability for outcomes arising from the use of SENDT targets in individual education plans or any other planning documentation.  

SENDT is not a medical, therapeutic, or diagnostic tool and should not be used as one.  

 

8. Limitation of Liability  

To the fullest extent permitted by law, SENDT and its operator shall not be liable for any indirect, incidental, or consequential loss arising from your use of the service, including but not limited to loss of data, loss of revenue, or damage to reputation.  

Our total liability to you in connection with these terms shall not exceed the total amount paid by you for the subscription in the 12 months preceding the claim.  

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.  

 

9. Changes to the Service and These Terms  

We reserve the right to update or modify SENDT at any time, including adding or removing content, features, or pricing tiers. Where changes materially affect a paid subscription, we will give reasonable notice.  

We may update these terms from time to time. The current version will always be available at sendt.org.uk. Continued use of SENDT after an update constitutes acceptance of the revised terms.  

 

10. Governing Law  

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of SENDT shall be subject to the exclusive jurisdiction of the courts of England and Wales.  

If you are accessing SENDT from outside England and Wales — including from Scotland, Ireland, Australia, New Zealand, Canada, or any other country — you agree that these terms are governed by the laws of England and Wales and that any disputes will be subject to the jurisdiction of the courts of England and Wales.
